Acas is the correct people to call. Especially if they sack him. The employment tribunal for england and wales is there to protect. The advice from acas is FREE |

Donna I'm shocked to hear of the way Dave is being treated by his company. I hope things can be resolved quickly; at least the VP in this country sounds a reasonable person to be dealing with. Thinking of you both. Stay positive! Love Helen |

hi Its against the law for any company to change your contract if you dont agree to it. They cant sacked you or change your terms and conditions because you refused to sign or agree to the new one either. He has to put it in writing within 30 days of being given his new contract. Donna, keeping my fingers crossed for you and Dave, it all sounds really horrible for both of you. I hope USA come to their sense's soon, sounds like they are throwing their rattle out of the pram. Cant give you any constructive advice except that it all sounds very dodgy what they are doing, and take all the legal advice that you can. Maggie |

**UPDATE** Dave has just rung. He had a meeting with HR over here and spoke to the VP and President. He still has a job and has been asked to put his reasons for not signing in writing. HR have a telephone meeting set for 6.30pm with USA Head of HR. That call is possibly crunch time. The UK office appear to be doing all they can....we shall see! Dave has decided he will leave, but hopefully in his own time and when it will have the most impact on them. He has already been offered another job, but with a major competitor, his company are going all out to stop Dave trying to join this company.....if he left his present company and went to the other one, that would have a major impact on his company. I should know more tomorrow. Thanks all of you for your help and concern xxx |

Strump, you're in the Uk so UK law will apply, regardless of what the Americans want, hubby pays tax to the UK inland revenue and NI contributions via his payslip, so I don't think the American company will have a leg to stand on. english law will apply here. Lisa |

Hi all Dave is paid from USA, though he is of course subject to UK tax etc. Dave has been in a meeting all morning re this. HR here have told HR in USA that the situation is to be resolved by close of business today, so far HR in Usa are standing firm. HR here, have warned that action will be taken against the company which is not in anyones best interest. They dont seem at all bothered by this though! I hope we know more later today, watch this space! Donna (who is not happy at being kept waiting) lol |

Hi Karen His employers have indeed stipulated he cannot work for a competitor, ive spoken to a solicitor today and as he has said, any other company in IT is a competitor and his employers are not able to stop him working. The new company (if he went to them) have said they are prepared for this......i will admit, this is the one thing im worried about. The longer it goes on, the worse im getting! Im trying not to panic. |

techinically - if they sack him they are terminating the contract he DID originally sign - so they can't stipulate who he works for in any manner. At most they can limit him working for anyone else during the notice period, as long as they pay him for that time. If he quits and they ask him to leave without working his notice period then the same still applies. They only 'own' him as long as they're paying him. Z |

How old is Dave? After our experience with redundancy (over 45) in past years, I would recommend anyone to be very careful not to throw in the towel before they have a new job set IN STONE! Lily |
